A defense attorney for a man charged in the murder of a former Baltimore city councilman says he needs more time to examine DNA evidence.

Attorney Jerome Bivens -- who's representing 16-year-old Jerome Williams -- told Judge Timothy Doory on Monday that he also needs to get in the Baltimore police crime lab and he needs more forensics.

The new trial is scheduled for January.

Williams, 20-year-old Charles McGaney and 20-year-old Gary Collins are charged in Kenneth Harris' death in a September robbery outside a jazz club.

McGaney and Collins have pleaded not guilty. Police were led to Williams after monitoring McGaney and Collins' phone calls in jail.
